Quelles sont les informations accessibles ?
Toute information enregistrée quelle que soit sa date ou sa forme (écrite, sonore ou visuelle) ou son support (papier ou électronique) produite ou obtenue par les structures soumises aux dispositions de la loi organique relative au droit d’accès à l’information dans le cadre de l’exercice de leurs activités.
Comment accéder à l’information ?
L’accès à l’information peut se faire soit en consultant le site web de la structure concernée si elle est publiée de manière proactive, soit en déposant une demande d’accès à l’information auprès de la structure concernée si l’information demandée n’est pas publiée.
Quelles sont les sanctions garantissant le droit d’accès à l’information ?
Toute personne qui entrave volontairement l’accès à l’information dans les structures soumises à la loi sur l’accès à l’information est passible d’une amende allant de 500 à 5000 dinars. Est également passible d’une peine d’un an d’emprisonnement et d’une amende de 120 dinars toute personne qui détruit volontairement une information de manière illégale ou incite une autre personne à le faire.
Quelles sont les formes possibles d’accès à l’information ?
Lors du dépôt d’une demande d’accès, le demandeur doit préciser la forme souhaitée :
Consultation de l’information sur place, à condition que cela ne lui cause aucun dommage,
– Obtention d’une copie papier de l’information,
– Obtention d’une copie électronique lorsque cela est possible,
– Ou obtention d’extraits de l’information.
La demande peut être déposée :
1- Directement auprès de la structure concernée contre un récépissé délivré à cet effet.
2- Par courrier recommandé, fax ou courrier électronique avec accusé de réception.
Quelles sont les structures soumises à la loi sur le droit d’accès à l’information ?
- La Présidence de la République et ses structures
- La Présidence du Gouvernement et ses structures
- L’Assemblée des Représentants du Peuple et ses structures
- Les ministères et les différentes structures sous tutelle à l’intérieur et à l’extérieur du pays

- Les établissements et entreprises publics et leurs représentations à l’étranger

Y a-t-il des frais pour accéder à l’information ?
Toute personne a le droit d’accéder gratuitement à l’information. Toutefois, si la fourniture de l’information nécessite des frais, le demandeur est informé à l’avance du paiement requis qui ne doit pas dépasser les dépenses réelles supportées par la structure concernée. Les cas où l’accès est payant sont strictement définis par des textes juridiques et aucun paiement ne peut être exigé sans base légale. Lorsque la loi prévoit un paiement pour l’accès à certaines informations ou formats, une preuve de paiement doit être fournie avant leur obtention.
Comment contester les décisions de refus d’accès à l’information ?
Un recours peut être déposé auprès du chef de la structure concernée dans un délai maximum de 20 jours suivant la notification de la décision. Le chef de la structure doit répondre dans les plus brefs délais et au maximum dans les 10 jours suivant le dépôt de la demande. L’absence de réponse dans ce délai constitue un refus implicite.
En cas de refus explicite ou implicite, le demandeur peut faire appel auprès de l’Instance d’accès à l’information dans un délai de 20 jours à compter de la notification ou du refus implicite. Il est également possible de saisir directement l’Instance dans le même délai.
Quel est le rôle du responsable de l’accès à l’information ?
Le responsable de l’accès à l’information est un élément essentiel dans l’application des dispositions de la loi organique n°22 de 2016 relative au droit d’accès à l’information. Cette personne est désignée par le chef de la structure concernée avec un adjoint par décision officielle précisant leur identité et leur fonction.

Quels sont les délais de réponse à une demande d’accès à l’information ?
La structure concernée doit répondre dans un délai maximum de 20 jours à compter de la réception de la demande. Si la demande concerne une consultation sur place, le délai est de 10 jours.
En cas de refus, celui-ci doit être motivé par écrit avec l’indication des voies de recours.
*Dans tous les cas, l’absence de réponse dans les délais légaux est considérée comme un refus implicite pouvant faire l’objet d’un recours.
What information is accessible?

How can information be accessed?
Information can be accessed either by consulting the concerned institution’s website if the information is proactively published, or by submitting a request for access to information if it is not published.
What penalties guarantee the right of access to information?
Any person who deliberately obstructs access to information within institutions subject to the access to information law may be fined between 500 and 5000 dinars. Any person who intentionally destroys information illegally or incites another person to do so is also liable to one year of imprisonment and a fine of 120 dinars.
What are the possible forms of access to information?

Are there fees for accessing information?
Every person has the right to access information free of charge. However, if providing the information requires costs, the applicant shall be informed in advance of the required payment, which must not exceed the actual expenses incurred by the concerned institution.
How can decisions refusing access to information be challenged?
An appeal may be submitted to the head of the concerned institution within a maximum period of 20 days from notification of the decision. The head of the institution must respond as quickly as possible and no later than 10 days after submission. Failure to respond within this period constitutes an implicit refusal.
In the event of an explicit or implicit refusal, the applicant may appeal to the Access to Information Authority within 20 days from notification or implicit refusal. It is also possible to directly refer the matter to the Authority within the same period.
What is the role of the Information Access Officer?
The Information Access Officer plays a key role in implementing the provisions of Organic Law No. 22 of 2016 related to the right of access to information. This officer and a deputy are appointed by official decision of the head of the concerned institution.

What are the response deadlines for an information access request?
The concerned institution must respond within a maximum of 20 days from receipt of the request. If the request concerns on-site consultation, the deadline is 10 days.
In case of refusal, the decision must be justified in writing with indication of appeal procedures.

كيف يمكن النفاذ إلى المعلومة؟
يمكن النفاذ إلى المعلومة إما عبر الاطلاع على الموقع الإلكتروني للهيكل المعني إذا كانت منشورة بصفة استباقية، أو عبر تقديم مطلب نفاذ إلى المعلومة لدى الهيكل المعني إذا لم تكن المعلومة منشورة.
ما هي العقوبات التي تضمن الحق في النفاذ إلى المعلومة؟
كل شخص يتعمد عرقلة النفاذ إلى المعلومة داخل الهياكل الخاضعة لقانون النفاذ إلى المعلومة يعاقب بخطية تتراوح بين 500 و5000 دينار. كما يعاقب بالسجن لمدة سنة وخطية قدرها 120 دينارًا كل من يتعمد إتلاف معلومة بطريقة غير قانونية أو يحرض غيره على ذلك.
ما هي أشكال النفاذ إلى المعلومة؟
عند تقديم مطلب النفاذ، يجب على الطالب تحديد الصيغة المطلوبة:
الاطلاع على المعلومة على عين المكان بشرط ألا يترتب عن ذلك ضرر،
– الحصول على نسخة ورقية من المعلومة،
– الحصول على نسخة إلكترونية إذا أمكن ذلك،
– أو الحصول على مقتطفات من المعلومة.
يمكن تقديم المطلب:
1- مباشرة لدى الهيكل المعني مقابل وصل استلام.
2- عبر البريد المضمون الوصول أو الفاكس أو البريد الإلكتروني مع إشعار بالاستلام.

هل توجد معاليم للنفاذ إلى المعلومة؟
لكل شخص الحق في النفاذ المجاني إلى المعلومة. غير أنه إذا استوجب توفير المعلومة مصاريف، يتم إعلام الطالب مسبقًا بالمبلغ المطلوب والذي لا يجب أن يتجاوز الكلفة الحقيقية التي تحملها الهيكل المعني. وتحدد النصوص القانونية بدقة الحالات التي يكون فيها النفاذ بمقابل، ولا يمكن فرض أي معاليم دون أساس قانوني.
كيف يمكن الطعن في قرارات رفض النفاذ إلى المعلومة؟
يمكن تقديم طعن لدى رئيس الهيكل المعني في أجل أقصاه 20 يومًا من تاريخ الإعلام بالقرار. ويجب على رئيس الهيكل الرد في أقرب الآجال وفي مدة لا تتجاوز 10 أيام من تاريخ تقديم الطلب، ويعتبر عدم الرد رفضًا ضمنيًا.
وفي حالة الرفض الصريح أو الضمني، يمكن للطالب الطعن لدى هيئة النفاذ إلى المعلومة في أجل 20 يومًا من تاريخ الإعلام أو الرفض الضمني، كما يمكن اللجوء مباشرة إلى الهيئة في نفس الأجل.
ما هو دور مسؤول النفاذ إلى المعلومة؟
يعتبر مسؤول النفاذ إلى المعلومة عنصرًا أساسيًا في تطبيق أحكام القانون الأساسي عدد 22 لسنة 2016 المتعلق بالحق في النفاذ إلى المعلومة. ويتم تعيينه مع نائب له بقرار رسمي من رئيس الهيكل المعني.
